Industrial laborers were widely subjected to asbestos exposure on the job, as the material was widely used throughout the 20th century. A criminal trial punishes those responsible for the dangerous product being present in a situation where it can harm people. When the prosecution is successful in these cases, it usually leads to jail time for the accused. However, the burden of proof for criminal trial is much more difficult to produce than that for a civil trial. You must be able to prove “beyond a reasonable doubt” that those responsible were aware that asbestos was a hazardous material, that they were aware that the way it was being used could cause death, and that they continued anyway.
